Please read these Terms of Service (“Terms,” “Terms of Service”) carefully before using the empoweredathome.com website (the “Site”) and any services, content, features, products, or applications offered by Empowered At Home (“we,” “us,” “our,” or “EAH”) (collectively, the “Services”).

These Terms constitute a legally binding agreement between you and Empowered At Home regarding your access to and use of the Site and Services. By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site or Services.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site and Services thereafter. Your continued use of the Site and Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

1. Eligibility and Account Registration

By using our Site and Services, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater;
• You have the legal capacity and authority to enter into these Terms;
• You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations;
• The information you provide to us is accurate, complete, and current at all times.

To access certain features of the Site, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Site and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to disable any user account at any time in our sole discretion, including if we determine that you have violated these Terms or that your account has been inactive for an extended period.

2. Products and Services

Empowered At Home provides a platform for discovering, learning about, and purchasing products related to artificial intelligence, robotics, smart home technology, and related educational content. Our offerings include, but are not limited to:

• Axiom Comics: A comic book series featuring the Axiom character and universe, available in digital and physical formats.
• Books and Educational Content: Publications focused on AI integration, smart home technology, and practical technology guides.
• Product Reviews and Recommendations: Curated information about third-party products including smart home devices, robots, and AI tools.
• Consulting Services: Professional guidance on website development, content creation, and AI implementation.
• Affiliate Marketing Opportunities: Partnership programs allowing individuals to earn commissions by promoting our products.

All product descriptions, specifications, and pricing are subject to change without notice. We make reasonable efforts to display our products and their features accurately. However, we do not warrant that product descriptions or other content on the Site is accurate, complete, reliable, current, or error-free.

3. Orders and Payment

When you place an order through our Site, you are making an offer to purchase the products or services in your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud.

All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Prices do not include applicable taxes, shipping, or handling charges, which will be added to your total during checkout. You are responsible for paying all applicable taxes and charges.

We use third-party payment processors to handle payment transactions. By submitting your payment information, you authorize us and our payment processors to charge the amount specified to your selected payment method. You represent and warrant that you are authorized to use the payment method you provide.

We reserve the right to limit the quantity of items purchased per person, per household, or per order. These restrictions may apply to orders placed by the same account, the same credit card, and/or orders that use the same billing and/or shipping address.

4. Shipping and Delivery

Shipping and delivery times are estimates only and commence from the date of shipping, not the date of order. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order. Unless there are exceptional circumstances, we make every effort to fulfill your order within the estimated timeframe.

Risk of loss and title for items purchased from our Site pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

5. Returns and Refunds

Our return and refund policies are designed to be fair and transparent. Specific return policies may vary by product type and are detailed on individual product pages and at checkout. Generally:

• Physical products may be returned within 30 days of delivery in original, unused condition.
• Digital products and downloadable content may not be eligible for return once accessed or downloaded.
• Custom or personalized items may not be returnable unless defective.

To initiate a return, please contact our customer service team. Refunds will be issued to the original payment method within 5-10 business days of receiving the returned item. Shipping costs for returns are the responsibility of the customer unless the item was defective or incorrectly shipped.

6. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Empowered At Home, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

All trademarks, service marks, logos, trade names, and any other proprietary designations of Empowered At Home used herein are trademarks or registered trademarks of Empowered At Home. Other trademarks, service marks, logos, trade names, and any other proprietary designations used herein are the property of their respective owners.

“Axiom,” the Axiom character, the Axiom Comics series, and all related characters, storylines, artwork, and content are the exclusive intellectual property of Empowered At Home and Axiom Enterprises. Unauthorized use, reproduction, distribution, or modification of any Axiom-related content is strictly prohibited.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Services for your personal, non-commercial use. This license does not include:

• Any resale or commercial use of the Site or its contents;
• Any collection and use of any product listings, descriptions, or prices;
• Any derivative use of the Site or its contents;
• Any downloading or copying of account information for the benefit of another merchant;
• Any use of data mining, robots, or similar data gathering and extraction tools.

Any use of the Site or its contents other than as specifically authorized herein is strictly prohibited. The license granted herein terminates automatically if you violate any of these Terms.

7. User Content and Conduct

The Site may contain interactive features that allow users to post, submit, publish, display, or transmit content and materials to us or on the Site, including but not limited to comments, reviews, forum posts, and social media interactions (“User Content”).

You retain ownership of any intellectual property rights that you hold in the User Content you post to the Site. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Site and our business, including without limitation for promoting and redistributing part or all of the Site.

You represent and warrant that:

• You own or control all rights in and to the User Content and have the right to grant the license granted above;
• All of your User Content does and will comply with these Terms;
• Your User Content is accurate and not misleading;
• Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

We have the right but not the obligation to monitor and edit or remove any User Content. We also have the right to terminate your access to all or part of the Site for any reason, including without limitation, any violation of these Terms.

You agree not to use the Site to:

• Post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable;
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Site;
• Post, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
• Interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site;
• Intentionally or unintentionally violate any applicable local, provincial, national, or international law;
• Collect or store personal data about other users without their express consent.

8. Affiliate Program

Empowered At Home offers an affiliate program that allows approved partners to earn commissions by promoting our products. Participation in the affiliate program is subject to the following terms:

• Affiliates earn a 30% commission on all qualifying sales of Axiom Comics and books generated through their unique referral links.
• Commission rates and qualifying products are subject to change with notice to active affiliates.
• Commissions are paid on a monthly basis via the payment method selected during registration, subject to a minimum payout threshold.
• Affiliates are responsible for complying with all applicable laws, regulations, and guidelines regarding advertising and marketing, including the FTC’s Endorsement Guides.
• Affiliates may not engage in deceptive, misleading, or unethical marketing practices.
• We reserve the right to terminate any affiliate relationship at any time for violation of these Terms or our Affiliate Program Policies.
• Affiliates must be at least 18 years of age to participate.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE OR SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH OR FROM THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

10. Limitation of Liability

IN NO EVENT SHALL EMPOWERED AT HOME, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE;
• ANY CONTENT OBTAINED FROM THE SITE; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE CLAIM AROSE, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100.00), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Empowered At Home, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site and Services, including, but not limited to, your User Content, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

12. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of the Province of Alberta. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Waiver and Severability

No waiver by Empowered At Home of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Empowered At Home to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Empowered At Home regarding the Site and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site and Services.
