Empowered At Home Affiliate Agreement

This Affiliate Agreement (“Agreement”) is entered into between Empowered At Home / Axiom Enterprises (“we,” “us,” “our,” or “EAH”) and you (“Affiliate,” “you,” or “your”). By applying to and participating in our Affiliate Program, you agree to be bound by the terms and conditions set forth below.

Please read this Agreement carefully. You must agree to these terms before submitting your affiliate application.

1. Affiliate Program Overview

Empowered At Home offers an affiliate program that allows approved partners to earn commissions by promoting Axiom Comics, Axiom books, and related products through unique referral links. Participation is free for those who already have a valid business number. If you do not have a business number, you may obtain one — registration costs are typically under $100.

2. Eligibility Requirements

To participate in the Affiliate Program, you must:

Be at least 18 years of age.
Have a valid PayPal account, Stripe account, OR a valid business number (GST/HST number or provincial business registration).
Maintain an active website, blog, social media presence, email newsletter, YouTube channel, podcast, or other platform where you can share your referral link.
Comply with all applicable laws, regulations, and advertising guidelines, including the FTC’s Endorsement Guides and Canada’s Competition Act.
Agree to all terms set forth in this Agreement.

Note: Having a business number is not mandatory if you have a valid PayPal or Stripe account for receiving commission payments. However, a business number simplifies tax reporting and demonstrates professional status.

3. Independent Contractor Status

You are an independent contractor, not an employee, agent, or partner of Empowered At Home. Nothing in this Agreement creates an employment relationship, partnership, or joint venture. You are solely responsible for:

All taxes, CPP contributions, and other statutory obligations arising from your affiliate earnings.
Obtaining and maintaining any licenses, permits, or registrations required for your promotional activities.
All costs and expenses associated with your marketing efforts.

We will issue a T4A slip for any affiliate who earns $500 or more in commissions during a calendar year, reporting payments in Box 020 (Self-employed commissions). You are responsible for reporting this income on your tax return.

Commission rates apply to the net sale price excluding taxes, shipping, and handling. Rates are subject to change with 30 days’ written notice to active affiliates.

5. Referral Tracking and Cookie Duration

Each approved affiliate receives a unique referral link.
Referral cookies last 30 days from the initial click.
Commissions are awarded on the last-click basis (the most recent affiliate link clicked before purchase).
Self-referrals are not permitted. You may not use your own affiliate link to purchase products for personal use.

6. Payment Terms

Commissions are calculated monthly and paid by the 15th of the following month.
Minimum payout threshold: $50 CAD. If your balance is below $50, it will roll over to the next month.
Payment methods: PayPal, Stripe transfer, or e-Transfer (Canada only).
All payments are made in Canadian Dollars (CAD).
We reserve the right to withhold payment if we suspect fraudulent activity, chargebacks, or violations of this Agreement.
Refunded or cancelled orders will result in commission reversal.

7. Marketing Guidelines and Restrictions

Affiliates are expected to promote our products ethically and honestly. The following practices are prohibited:

No deceptive marketing: You may not make false, misleading, or unsubstantiated claims about our products.
No spam: You may not send unsolicited commercial emails (spam) or use automated messaging systems to distribute your affiliate link.
No paid search bidding: You may not bid on our branded keywords (Axiom, Empowered At Home, Axiom Comics, Axiom Enterprises) in paid search advertising (Google Ads, Bing Ads, etc.).
No coupon sites: You may not promote your affiliate link on coupon, deal, or discount aggregation websites without prior written approval.
No trademark infringement: You may not use our trademarks, logos, or brand names in a way that suggests endorsement, partnership, or official representation without written consent.
No objectionable content: You may not promote our products on websites or platforms containing hate speech, violence, discrimination, pornography, or illegal content.
FTC compliance: All affiliate promotions must include clear and conspicuous disclosure of your affiliate relationship, as required by the FTC and Canadian Competition Bureau.

8. Intellectual Property

We grant you a limited, non-exclusive, revocable license to use our approved marketing materials (banners, images, product photos, and sample copy) solely for the purpose of promoting our products under this Agreement. You may not modify, alter, or create derivative works from our intellectual property without written consent.

All Axiom characters, storylines, artwork, logos, and brand elements are the exclusive property of Empowered At Home and Axiom Enterprises. Unauthorized use is strictly prohibited.

9. Term and Termination

This Agreement begins on the date of your acceptance into the Affiliate Program and continues until terminated by either party.

Termination by Affiliate: You may terminate this Agreement at any time by providing written notice to affiliates@empoweredathome.com. Commissions earned prior to termination will be paid according to the standard payment schedule.

Termination by Empowered At Home: We may terminate this Agreement immediately and without notice if you violate any term of this Agreement, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, all affiliate links will be deactivated and any unpaid commissions may be forfeited at our discretion.

10. Limitation of Liability

We will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to this Agreement or the Affiliate Program. Our total liability to you for any claim arising under this Agreement shall not exceed the total commissions paid to you in the three (3) months preceding the claim.

11. Confidentiality

You may receive confidential information about our business, products, customers, or marketing strategies. You agree to maintain the confidentiality of such information and not disclose it to any third party without our prior written consent.

12. Modification

We reserve the right to modify this Agreement at any time. Changes will be effective upon posting to the Site. Your continued participation in the Affiliate Program after any modification constitutes your acceptance of the revised Agreement.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.

14. Acknowledgment

By checking the “I agree” box on the affiliate application form, you confirm that:

You have read, understood, and agree to be bound by this Affiliate Agreement.
You meet all eligibility requirements outlined in Section 2.
You understand that you are an independent contractor responsible for your own taxes and legal compliance.
You agree to promote our products ethically and in accordance with all applicable laws.
